These Terms of Service ("Terms") are a legal agreement between you and Cody Rumble, operating as Rumbles Safety Solutions ("Safety Sentinel", "we", "us") governing your access to and use of the Safety Sentinel application, website and related services (the "Service"). By creating an account, joining a facility, or using the Service, you agree to these Terms. If you are accepting on behalf of a company, you confirm you have authority to bind that company, and "you" refers to that company.
If you do not agree to these Terms, do not use the Service.
1. What the Service is
Safety Sentinel is a workplace safety management platform for industrial and manufacturing environments. It lets workers report hazards, near misses and observations; lets safety leads triage, assign and resolve them; and provides supporting tools for inspections, audits, corrective actions, permits, lockout/tagout, management of change, safe work methods, simultaneous operations, SDS and chemical inventory, PPE stock, training, emergency muster, spill response, and OSHA and ISO 45001 recordkeeping.
The Service includes AI-assisted features that analyse photos, text and maintenance records and generate suggested hazard classifications, standards references, corrective actions, forecasts and reports.
2. Accounts and eligibility
2.1 You must be at least 18 years old and legally able to enter into a contract to create an account.
2.2 You must provide accurate account information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account.
2.3 Accounts are assigned to a facility. A facility administrator controls membership, roles and permissions within that facility. If you join a facility, that facility's administrators can see activity and records associated with your membership.
2.4 You are responsible for your users' compliance with these Terms. Do not share accounts between individuals.
3. Free trial
3.1 A new facility receives a 14-day free trial starting when the facility is created. No payment method is required to begin the trial.
3.2 The trial includes the functionality we make available during the trial period. We may change trial scope, but will not shorten a trial already in progress.
3.3 When the trial ends, access to facility workspaces is suspended until a subscription is purchased. Your data is retained as described in Section 11.
3.4 Trial abuse (for example, repeatedly creating facilities to extend free access) is not permitted.
4. Subscriptions, fees and payment
4.1 Plans. The Service is licensed per facility on a subscription basis. Current plans and prices are published in the app's Billing section and on our pricing page:
| Plan | Monthly | Annual | |
|---|---|---|---|
| Starter | $299 / month | $2,990 / year | 21 core safety modules |
| Professional | $699 / month | $6,990 / year | Starter plus Safety Forecast, AI analytics, Teams alerts |
| Enterprise | $1,999 / month | $19,990 / year | Professional plus compliance suite, multi-facility, API |
| Additional facilities | $499 / month each | — | Enterprise plan only |
4.2 Users. Each subscription covers all users at the subscribing facility. There are no per-seat charges.
4.3 Annual billing. Annual plans are billed once per year and are priced at the equivalent of ten months, saving two months against the monthly rate.
4.4 Promotions. Promotional pricing, early-adopter discounts and promo codes are offered at our discretion, apply only as stated, cannot be combined unless we say so, cannot be applied retroactively, and may be withdrawn for future billing periods. Discounts apply to the billing cycle in which they are granted.
4.5 Payment processing. Payments are processed by our payment provider (Base44 Payments). Card details are collected and stored by the payment provider on its hosted checkout page, not by us. By subscribing you authorise recurring charges for the selected plan and billing cycle until you cancel.
4.6 Renewal. Subscriptions renew automatically at the end of each billing period at the then-current rate for your plan, unless cancelled before renewal. We will give reasonable notice of price changes affecting an active subscription.
4.7 Taxes. Fees are exclusive of applicable sales, use, VAT or similar taxes, which you are responsible for, other than taxes on our net income.
4.8 Late or failed payment. If a charge fails, we may retry it and may suspend access until payment succeeds. Access is restored when the outstanding balance is paid.
4.9 Cancellation. Facility administrators can cancel at any time from the Billing section. Cancellation turns off auto-renewal; the facility keeps access until the end of the current paid period, after which access ends. Cancelling does not entitle you to a refund of amounts already paid.
4.10 Refunds. [CONFIRM YOUR POLICY - for example: "Fees are non-refundable except where required by applicable law." or "We will refund an annual subscription in full if you cancel within 14 days of the initial charge and have not previously subscribed."]
4.11 Price changes. We may change plan prices. Changes apply from your next renewal, not to a period you have already paid for. Existing customers on a discontinued or legacy plan keep their existing rate for as long as their subscription remains active and uninterrupted.
5. Licence and acceptable use
5.1 Licence grant. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business purposes during your subscription term.
5.2 Restrictions. You may not:
(a) copy, modify, resell, sublicense, rent, lease or distribute the Service or provide it as a service bureau to third parties;
(b) reverse engineer, decompile or attempt to derive source code, except to the extent that restriction is prohibited by law;
(c) access the Service to build a competing product, or scrape or bulk-extract data other than your own;
(d) attempt to gain unauthorised access to any account, facility, system or network, or probe, scan or test its vulnerability;
(e) interfere with the integrity or performance of the Service, including by circumventing usage limits, role restrictions, facility isolation or plan gating;
(f) upload malicious code, or content that is unlawful, defamatory, harassing or infringes third-party rights;
(g) use the Service in a way that breaches applicable law, including privacy, employment and workplace safety law.
5.3 Suspension. We may suspend or terminate access if we reasonably believe you have materially breached these Terms, if your use creates a security or legal risk, or if fees remain unpaid. Where practicable, we will give notice and an opportunity to remedy.
6. Your data
6.1 Ownership. You own the content you and your users submit to the Service, including reports, photos, inspection records, audit findings, training records and documents ("Customer Data"). We do not claim ownership of Customer Data.
6.2 Licence to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit and display Customer Data solely to operate, secure, maintain and support the Service, and to comply with law. This licence ends when Customer Data is deleted, except for backups retained for a limited period and content we must retain by law.
6.3 Responsibility. You are responsible for the accuracy, quality, legality and appropriate handling of Customer Data, including whether you have a lawful basis and any required notices or consents for collecting and processing information about your workers. Do not submit data you are not permitted to submit.
6.4 Facility isolation. Records are scoped to the facility they belong to and are filtered to the signed-in user's facility and role. You acknowledge that facility administrators and corporate-level super administrators may access records across the facilities they are authorised for.
6.5 Aggregated data. We may use de-identified, aggregated data that does not identify you or any individual to operate, benchmark, improve and promote the Service.
6.6 Feedback. If you send us suggestions, we may use them without obligation to you.
7. AI-assisted features - important limitations
7.1 Parts of the Service use artificial intelligence to generate suggested hazard classifications, standards references, penalty exposure estimates, root-cause analyses, training content, forecasts and recommendations.
7.2 AI output is a suggestion, not a determination. It may be incomplete, out of date or wrong. It is not reviewed by a qualified safety professional before you see it, and it must be reviewed by a competent person before you rely on it.
7.3 You remain solely responsible for your safety decisions, corrective actions, hazard assessments, incident classifications and regulatory filings. Do not use AI output as the sole basis for a decision that affects anyone's health or safety.
7.4 Estimated penalty figures, citation probabilities, risk scores and premium estimates are illustrative modelling, not predictions or quotations, and must not be represented to a regulator, insurer or court as fact.
8. No legal, safety or compliance guarantee
8.1 The Service is a recordkeeping and workflow tool. It is not legal advice, industrial hygiene advice, engineering advice or a substitute for a qualified safety professional.
8.2 Using the Service does not by itself make you compliant with OSHA, ISO 45001 or any other standard, regulation or law. Compliance depends on your own programmes, training, controls, recordkeeping and conduct.
8.3 We do not file anything with any regulator on your behalf. Documents the Service generates (including OSHA 300, 300A and 301 forms) are drafts for your review, signature and retention; you are responsible for their accuracy, timeliness and submission.
8.4 You are responsible for determining which laws and standards apply to your operations and for maintaining your own records as required.
9. Third-party services
9.1 The Service can connect to third-party services you choose to enable, such as Slack, Microsoft Teams, Google Calendar, Google Sheets and identity providers.
9.2 Your use of a third-party service is governed by that provider's terms and privacy policy. We are not responsible for third-party services, their availability, or the content you send to them. Enabling an integration may transmit data (for example, a summary of a safety report) to that provider.
9.3 You are responsible for the credentials and webhook URLs you configure and for ensuring you are authorised to send data to those destinations.
10. Service availability and changes
10.1 We aim to keep the Service available and secure, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable during maintenance, upgrades, or events outside our reasonable control.
10.2 We may add, modify, deprecate or remove features. We will not materially reduce the core functionality of a paid plan during a paid period without reasonable notice.
10.3 We may use service providers (including cloud hosting, database, email and payment providers) to deliver the Service.
11. Term, termination and data retention
11.1 These Terms apply while you use the Service.
11.2 You may stop using the Service at any time. Cancelling a subscription ends access at the end of the current paid period, as described in Section 4.9. Account deletion can be requested in the app or by contacting us.
11.3 We may terminate these Terms and your access if you materially breach them and fail to remedy the breach within 14 days of notice, or immediately if required by law or if your use creates a security or legal risk.
11.4 Data on termination. After access ends, we retain Customer Data for [RETENTION PERIOD - for example 30 days] so you can export it or reactivate. After that period we may delete it, except where we are required by law to retain it or where it exists in backups until those backups expire. Export your data before your subscription lapses if you need it.
11.5 Sections that by their nature should survive termination - including ownership, disclaimers, limitation of liability, indemnity and governing law - survive.
12. Support
Support is provided by email at bluewatermasonry4@gmail.com. Enterprise plans include priority support with a four-hour response target and a dedicated onboarding session. Response targets are targets, not guarantees.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY AI OUTPUT OR ESTIMATE IS ACCURATE OR COMPLETE.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
14. Limitation of liability
14.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY.
14.2 OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE FEES YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM.
14.3 Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot be limited by law.
14.4 Each party's liability limits apply collectively to that party and its affiliates.
15. Indemnity
You will defend and indemnify us against third-party claims, damages, liabilities and reasonable costs arising from (a) Customer Data you submit, (b) your unlawful or unauthorised use of the Service, (c) your breach of Sections 5 or 6, or (d) a safety, employment or regulatory decision you make using the Service.
16. Confidentiality
Each party will protect the other's non-public information with reasonable care and use it only to perform under these Terms. This does not apply to information that is public, independently developed, or required to be disclosed by law (with prompt notice where lawful).
17. Governing law and disputes
17.1 These Terms are governed by the laws of the [STATE / COUNTRY], without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
17.2 Before filing a claim, the parties will attempt to resolve the dispute in good faith for 30 days by written notice. Unresolved disputes will be brought exclusively in the state or federal courts located in [COUNTY, STATE], and each party consents to their jurisdiction.
17.3 Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
17.4 Claims must be brought within one year of the event giving rise to them, unless applicable law requires otherwise.
18. Changes to these Terms
We may update these Terms. If we make a material change, we will notify you in the app or by email before it takes effect. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and cancel before the change takes effect.
19. General
19.1 These Terms, together with our Privacy Policy, are the entire agreement between us on this subject and supersede prior discussions.
19.2 You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition or sale of assets.
19.3 If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
19.4 Notices must be in writing to bluewatermasonry4@gmail.com (for you, the email on your account).
19.5 There are no third-party beneficiaries other than your affiliates and our affiliates.
